All of the firm’s lawyers work with commercial dispute resolution on a daily basis, including negotiations, mediation (both in and outside of the courts), and litigation before the ordinary courts and through arbitration. Several of the firm’s lawyers are admitted to the Norwegian Supreme Court. This brings freedom of expression to the forefront, but also all the limitations of freedom of expression. Freedom of expression can be limited by rules on, among other things, privacy, copyright, and marketing law. The rules on what information and content can be legally processed and communicated are complex and partly unclear. They are not found in a single law, and in this field, Norwegian law is also governed by both EU/EEA law, human rights conventions, and other international law, with corresponding practices from both Norwegian and international courts, such as the EU Court of Justice, the EFTA Court, and the European Court of Human Rights. These rules come into play when both individuals and commercial actors or public authorities post and share text, images, videos, and other content on social media, and when traditional media publish and broadcast their content. Here, rules on, among other things, privacy, the right to one's own image, defamation, copyright, and marketing law will constitute limitations on what can be legally published/communicated. And regardless of what one chooses to publish/communicate, all electronic processing of information about individuals will, in principle, be subject to the Personal Data Act and the EU General Data Protection Regulation (GDPR), which impose a number of requirements on the basis for processing. Geir-Arne Heiestad Borgestrand

Geir-Arne Heiestad Borgestrand specializes in dispute resolution and general contract law with a particular focus on fabrication and supply contracts. Geir-Arne has in recent years headed Glittertind’s Department of Energy and Industry, where he has mainly worked with dispute resolution and been a litigator in several major disputes within both construction and subsea fabrication contracts. He has previously worked as Head of Legal for Aker Solutions ASA’s business sectors Engineering and Subsea. Prior to that, he worked on civil dispute resolution within construction and finance at the law firm BA-HR DA. Geir-Arne has extensive international experience within contract drafting, project support and dispute resolution related to major construction contracts.
