The firm was established in 1980 by Dr Javier Tamayo Jaramillo with the objective of providing specialized legal advice and representation in judicial and arbitration litigation in civil and state liability, insurance and reinsurance law, and transportation law. Subsequently, the firm adopted the name of TAMAYO JARAMILLO & ASOCIADOS, and included new areas of work, such as advice on the celebration and execution of contracts, handling of class actions law suits, cassation suits and public contracting. In 2020, Dr Javier Tamayo Jaramillo included as partners and shareholders of TAMAYO JARAMILLO & ASOCIADOS five of the most distinguished lawyers who have worked for the firm: Carlos Andrés González Galvis, Laura Castaño Echeverri, Daniel Ossa Gómez, Margarita Jaramillo Cossio and Luis Miguel Gómez Gómez Gómez. Dr Javier Tamayo Jaramillo continues as founding partner and director of the firm, and Dr Alfonso Cadavid Quintero serves as a consultant in criminal matters. - Main areas of practice Dispute resolution: The firm has extensive experience in the representation of its clients before the ordinary and administrative jurisdiction. Also before arbitration courts, including the preparation and opposition of appeals for annulment of arbitral awards. The firm assists its clients in class action law suits brought to court in matters related with: land and air transportation accidents, collapse or ruin of constructions of all kinds, environmental pollution, earthquakes, explosions, floods, fires, defective or dangerous products, etc. During the last few years we have successfully represented companies sued for the contamination of the Bogotá River and for the construction of hydroelectric projects. We are currently representing victims in several class actions arising from the ruin of several buildings in the city of Medellín. Insurance: We provide advice in legal and technical situations related to insurance contracts. Particularly, the firm attends judicial and extrajudicial claims, objections and reconsiderations, among others, in matters of: Personal insurance: life insurance, personal accident insurance, hospitalization and surgery insurance. Compliance and liability insurance: general liability insurance (with all its special coverages, particularly product liability insurance), compliance bonds, credit insurance, directors and officers insurance, professional liability insurance, errors and omissions insurance, fidelity and financial risks insurance . Damage and property insurance: transport insurance associated with any mode of transport (road, river, rail, maritime and air), fire insurance, loss of profit insurance, construction and assembly insurance. Our role also extends to assisting our clients in all legal aspects related to the insurance contract, including advice on the design and structuring of the insurance program, the handling of judicial and arbitration proceedings related to this contract, representing the insurer, the insured and, in the case of liability insurance and personal insurance, also the beneficiaries. Likewise, we are adjusters in claims of all types of policies, particularly in compliance and liability policies. Finally, we also advise on reinsurance matters (proportional and non-proportional, and the different categories within them). Transportation: The firm’s lawyers are highly qualified to provide legal advice as well as legal proceedings (including arbitration) related to the contract of carriage of persons and goods, associated with all modes of transportation (road, river, rail, air and maritime), as well as all matters related to transportation insurance. Contract law advisement: We are experts in drafting contracts for our clients, ensuring that their interests and needs are duly regulated. In addition, we provide ongoing advice during the stages of execution, termination and liquidation of the contract, drafting and reviewing communications, studying documents and issuing professional opinions at the request of our clients, all with a view to preventing eventual disputes from reaching the courts.
