Edoardo Raffiotta

Since 2022, he has been Of Counsel at LCA. Edoardo is a Lawyer and Professor of Constitutional Law at the University of Milan Bicocca. He also teaches administrative law, innovation law and artificial intelligence law. Since March 2023, he has been Admitted to practice before the Italian Supreme Court. By Decree of the President of the Council of Ministers of 13 October 2023, Edoardo was appointed by the Italian Government as one of the thirteen members of the Coordination Committee for the updating of national strategies on the use of artificial intelligence in support of the Undersecretary of State for Technological Innovation and Digitalisation Sen. Alessio Butti. Since March 2021, he has been Legal Adviser to the Data Protection Authority, until joining (October 2023) the Government Coordination Committee for the update of national strategies on the use of artificial intelligence. In October 2023 he was elected by the City Council of Milan, by a two-thirds majority, Component of the Committee of Guarantors of the City of Milan. Since December 2021, he has been a Fellow of the Research Centre in Public Law and Policy at the Berkeley School of Law – University of California, with a research assignment on the legal profiles of artificial intelligence and cybersecurity. As a lawyer, he has gained significant experience in all major regulatory areas of public law. He is particularly interested in public law issues of economics and technological innovation in services, with a specific focus on data protection, artificial intelligence, and cybersecurity.

Edoardo is a partner in our Corporate & Commercial group, leading the Digital Business practice and the TMT sector in Italy. He specializes in national and cross-border M&A, corporate transactions and large-scale project contracts primarily related to Tech and data monetization (from Telco to Automotive, from HLS to Financial Institutions and data centre). Edoardo advises international clients on acquisitions, development capital and day-to-day business operations within the TMT and Digital Business sectors. He has mentored a number of incubators and start-up. He oversees GDPR and AI and data-related issues, focusing on compliance, cross border transfers as well as blockchain and crypto matters. Edoardo co-leads the Automotive Tech group globally and the Italian Cybersecurity and Insurtech Task Force, advising on mobility, smart cities, and data platforms. Recently he has been focused specifically on the evolution of the digital therapeutics in HLS as well as the use of alternative data to boost clinical trials and drug discovery (from insilico to gravity zero generated data). As a partner in our Milan-based Intellectual Property practice, I focus on patents, trade marks, design and unfair competition litigation, assisting our Italian and international clients with contentious matters on a domestic and pan-European basis. My early fascination with method and logic has evolved into examining fine details in intellectual property litigation. My continued interest in this area has led me to specialise in complex patent disputes in the mechanical, pharmaceutical and electronic sectors, comprising standard essential patents litigation. Since joining Bird & Bird in 2011, I've been dealing with contentious matters relating to coffee capsule patents and have acquired in-depth knowledge of this specific industry. I also assist clients in trade mark contentious issues, enforcement of design and trade-dress protection, as well as in proceedings regarding unfair competition practice before the Italian Competition Authority (ICA). I am currently working on a new project in my role as product design ambassador for Italy within Bird & Bird's International Product Design Group. We aim to develop greater insight into design protection and share our expertise in prosecution and enforcement with relevant industry sectors. As a recent participant in Bird & Bird's Global Women's Development Programme, I am proud to attest to the firm's stance on gender diversity.
