Paul Breithaupt is a lawyer in the field of European and Dutch competition law and sector-specific regulation. Paul regularly assists companies in obtaining approval for mergers, acquisitions and joint ventures from the Dutch Healthcare Authority (NZa) en the Authority for Consumers & Markets (ACM). Paul is a well-rounded practitioner and has a broad litigation experience having advised clients in a wide range of contentious matters. He was called to the Bar of England and Wales in 2017 and subsequently to the Gibraltar Bar in 2019. Peter specialises in European competition law, with a particular emphasis on high-profile and complex M&A-related competition law issues. Peter has considerable experience in European, Danish, and multi-jurisdictional merger control matters. Peter has led a number of high-profile merger control filings (both domestically and with the European Commission) within different complex industries (including biotech, energy, and IT services). Peter is particularly well-versed in providing strategic and deal certainty analyses of prospective transactions and also advises on all other transaction-related competition law issues, including how to handle the practical challenges associated with integration planning. Peter also regularly advises on matters related to abuse of dominance, including how to organise distribution systems and agreements to avoid pricing and discrimination abuse He has extensive experience in public procurement law, particularly in the medical and pharmaceutical industries, as well as large-scale infrastructure and energy projects. Peter has a Master's degree in Law from the University of Copenhagen and a Master of Laws with distinction from King's College London (specialising in EU competition law). In addition, the High Court of Eastern Denmark held an interim judgeship in 2021, allowing Peter to appear before it. Peter is also an experienced lecturer, having served as an external lecturer at King's College London from 2017–2020. Peter has worked on the most complex and sensitive mandates in the field of competition law and he is very well experienced in this area. Peter has represented clients during inspections (dawn raids) of the Antimonopoly Office of the Slovak Republic (AMO), in cartel investigations, during investigations regarding abuse of dominance as well as during subsequent court review of decisions of AMO. Peter was the first in Slovakia to file a leniency application. Peter supported clients in complicated concentrations. He was the first in Slovakia to apply the implementation of a condition in a decision by which the AMO approved a concentration with a condition according to the EU model. Peter has also advised on several cases involving dominance. Peter has been regularly highly rated in Chambers Europe in the past.
